Beyond Celiac shall not be liable to any User of the GREAT Kitchens™ Materials, or to any third party, for any loss, expense or damage, including but not limited to consequential, incidental, special, direct, indirect or punitive damages of any kind, including lost profit or revenue, however such damages arise, even if advised of the possibility thereof, that results directly or indirectly from the use of or reliance upon the GREAT Kitchens™ Materials, their content or other information obtained, downloaded, linked or otherwise accessed through the GREAT Kitchens™ Materials.
Beyond Celiac Acceptable Use Policy
The Learner has been provided the following course materials in connection with the Learner’s enrollment in the GREAT Kitchens™ Program (“GREAT Kitchens Materials”):
- GREAT Kitchens™ Course consisting of the web-based course material, including an introduction and modules in video and audio format;
- GREAT Kitchens™ Course Manual and all portable document files (pdf);
- GREAT Kitchens™ supplemental information, including the GREAT Kitchens™ Bilingual DVD (English and Spanish; and
- Beyond Celiac “Do I Have Celiac?” Brochures.
The Learner has the right to use the GREAT Kitchen™ Materials, whether provided in printed or electronic media format, solely in the course of operations, including in a Train-the-Trainer capacity, in the primary restaurant or business location (“Primary Location”). Use of the GREAT Kitchens™ Materials is prohibited at any other location unless additional logins are purchased for each such location. [Beyond Celiac is willing to discuss additional arrangements for chain restaurants, consulting programs and other training programs, upon request.] Specifically, the Learner is prohibited from using the GREAT Kitchens™ Materials outside of its Primary Location. Learner may not post the GREAT Kitchens™ Materials on any intranet or internet. No portion of the GREAT Kitchens™ Materials may be reproduced, copied, distributed, or disseminated in any form or by any means, without the express written permission of the Beyond Celiac.
The GREAT Kitchens™ Materials are protected by copyright and/or other intellectual property laws, and any unauthorized use of the GREAT Kitchens™ Materials may violate such laws. The rights granted to the Learner constitute a limited license to use and not a transfer of title. The GREAT Kitchens™ Materials may not be modified or altered in any way and any copyright or other proprietary notices contained in the GREAT Kitchens™ Materials may not be removed.
INDEMNIFICATIONUsers of the GREAT Kitchens Materials expressly understand and agree that such use and implementation is the sole responsibility of the User and at User’s own risk.
